These Terms of Use ("Terms") govern your access to and use of the website, mobile application, products, consultations, courses, sessions, content, and related services offered by Garbhrakshaa ("Platform").

• "Garbhrakshaa", "we", "us", and "our" refer to Garbhrakshaa, operated by Mrs. Krutika Gunjan Mehta.

By accessing or using the Platform, you agree to be legally bound by these Terms, our Privacy Policy, Refund Policy, Disclaimer, and all other applicable policies published on the Platform.

By using the Platform, you represent and warrant that:

Use of the Platform and reliance on any information is solely at your own risk.

Certain features of the Platform may require registration. By registering, you agree that:

• All information submitted by you is accurate and complete;
• You shall maintain confidentiality of login credentials;
• You shall be solely responsible for activities conducted through your account.

We reserve the right to verify information, request additional information, or suspend/terminate accounts found to contain false or misleading information.

Registration may presently be free of cost. However, Garbhrakshaa reserves the right to introduce subscription fees or service charges at any time.

We strive to ensure uninterrupted access to the Platform. However, we do not guarantee that the Platform will always be available, access will be uninterrupted, or errors will not occur.

Consultations, sessions, deliveries, or courses may occasionally be delayed or rescheduled due to circumstances beyond our reasonable control including:

• Technical failures
• Internet outages
• Weather conditions
• Public restrictions
• Medical emergencies
• Force majeure events

You agree not to:

• Upload or share unlawful, defamatory, obscene, abusive, hateful, misleading, fraudulent, or harmful content;
• Infringe intellectual property rights of any person;
• Impersonate another individual;
• Distribute malware, viruses, or harmful code;
• Attempt unauthorized access to the Platform or related systems;
• Engage in hacking, scraping, data mining, or automated extraction;
• Interfere with Platform functionality;
• Post content violating Indian laws or post medical misinformation;
• Harass or threaten any person;
• Misuse consultations or educational material;
• Use the Platform for commercial exploitation without authorization;
• Copy, record, redistribute, resell, or reproduce course or consultation material;
• Make defamatory statements against Garbhrakshaa or its brand identity.

We reserve the right to remove any content or restrict access where such content violates these Terms or applicable law.

If you submit reviews, comments, feedback, testimonials, photographs, videos, or any other material:

• You grant Garbhrakshaa a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and publish such content for lawful business purposes;
• You confirm that you own or have necessary permissions for such content.

You remain solely responsible for content submitted by you. We reserve the right to remove or moderate any user-generated content without prior notice.

All content available on the Platform — including text, graphics, videos, logos, branding, audio, illustrations, course materials, consultation formats, PDFs, frameworks, methodologies, educational resources, product descriptions, and all proprietary material — are the exclusive intellectual property of Garbhrakshaa or its licensors.

No content may be copied, reproduced, recorded, republished, uploaded, modified, translated, transmitted, distributed, sold, or commercially exploited without prior written consent from Garbhrakshaa.

Access to the Platform does not transfer ownership of any intellectual property rights.

Accepted payment methods may include:

• UPI
• Net Banking
• Debit Cards
• Credit Cards
• Wallets
• Other approved payment gateways

You represent that you are authorized to use the chosen payment method and that all payment information is lawful and accurate. All applicable taxes shall be borne by the user unless stated otherwise.

Refunds or replacements may be provided only in the following situations:

• Products received in damaged condition due to transit;
• Expired products delivered;
• Incorrect products delivered.

Upon verification and approval, refunds may be processed within 15 business days through approved banking/payment channels only.

Any confidential information exchanged between users and Garbhrakshaa shall be treated confidentially except where disclosure is legally required, necessary for service delivery, or authorized by the concerned party.

Users shall not disclose proprietary information, educational material, internal documents, or confidential consultation information belonging to Garbhrakshaa without written permission.

The Platform may contain links to third-party websites or applications for convenience only. Garbhrakshaa does not endorse third-party content, is not responsible for external websites, and is not liable for privacy practices or transactions conducted through third-party platforms.

Users access such third-party websites at their own risk.

To the maximum extent permitted under applicable law:

• Garbhrakshaa shall not be liable for indirect, incidental, special, punitive, or consequential damages;
• Liability, if any, shall not exceed the amount paid by the user for the relevant Service.

We do not guarantee specific wellness outcomes, pregnancy outcomes, childbirth outcomes, therapeutic outcomes, or medical improvements.

Use of the Platform is entirely at the user's own discretion and risk.

You agree to indemnify and hold harmless Garbhrakshaa, its proprietor, affiliates, consultants, employees, and service providers from and against any claims, liabilities, damages, penalties, losses, legal costs, and expenses arising from:

• Your violation of these Terms;
• Misuse of the Platform;
• Infringement of third-party rights;
• Unlawful conduct;
• Breach of applicable law.

We reserve the right to suspend, restrict, terminate, or permanently block access to any user without prior notice if:

• These Terms are violated;
• Unlawful activity is suspected;
• Misuse of the Platform occurs;
• Required by law or governmental authority.

Termination may also occur due to technical issues, operational discontinuation, security concerns, or voluntary account deletion requests.

Garbhrakshaa shall not be liable for delay or failure in performance resulting from causes beyond reasonable control including:

• Natural disasters,
• War,
• Pandemics,
• Internet failures,
• Governmental restrictions,
• Labour disputes,
• Power failures,
• Cyberattacks,
• Or other force majeure events.

We may temporarily suspend access to the Platform for maintenance, upgrades, security checks, technical modifications, or infrastructure improvements.

We shall not be liable for temporary unavailability or data loss arising from such interruptions.

These Terms shall be governed by and construed in accordance with the laws of India.

If any provision of these Terms is held unlawful, invalid, or unenforceable, the remaining provisions shall continue in full force and effect.

We reserve the right to revise, amend, or modify these Terms at any time without prior notice.

Continued use of the Platform following updates shall constitute acceptance of revised Terms.
